Global Hosting Services Inc. has a responsibility to protect each client and to provide the best service available. The following guidelines were designed to ensure these obligations are met. You must agree to all of these terms prior to signing up with Global Hosting Services Inc.. Under the terms of this agreement, your placement of information on Global Hosting Services Inc.'s servers is an acknowledgement that you have read and understood this agreement, and that you agree to be bound by the terms and conditions below. If you do not wish to be bound by these terms and conditions, you should not proceed to place any information of any kind on Global Hosting Services Inc.'s servers.

1. Content

All services provided by Global Hosting Services Inc. may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene or material protected by trade secret and other statute, and invasion of privacy. The subscriber agrees to indemnify and hold harmless Global Hosting Services Inc. from any claims resulting from the use of the service which damages the subscriber or any other party.

All pornographic content and sex-related merchandising is prohibited on all Global Hosting Services Inc. servers. This includes sites that may infer sexual content or links to adult content elsewhere. Global Hosting Services Inc. will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to Global Hosting Services Inc. servers or any other server on the Internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

• Pirated software
• Sex-related sites
• Hacker programs or archives
• Warez sites

Global Hosting Services Inc. will be the sole arbiter as to what constitutes a violation of this provision.

2. Commercial

Advertising Spamming, or the sending of unsolicited email, from a Global Hosting Services Inc. server or using an e-mail address or domain that is maintained on a Global Hosting Services Inc. machine as reference is STRICTLY prohibited. Clients that are found to be spamming or sending large quantities of unsolicited email will be immediately deactivated and no refunds will be offered on any payments made. We constantly monitor for spamming on all servers. Global Hosting Services Inc. will be the sole arbiter as to what constitutes a violation of this provision.

3. Domain Registration

Domain names are your property upon registration, and cannot be returned for refund.

4. Domain Pointing

Domain pointers are to be used for the purpose of having more than one way to find the same site, not for the purposes of sharing an account among multiple sites. A domain pointer may not be setup to reference a subdirectory within an existing web hosting account served by Global Hosting Services Inc. or any other provider.

5. Server Abuse

Any attempt to undermine or cause harm to a server, or customer, of Global Hosting Services Inc. is strictly prohibited, and will result in immediate termination or prosecution. This includes, but is not limited to: using programs that consume excessive CPU time; allowing the use of mail services, mail forwarding capabilities, or auto-responders other than for the customer's own account; resale of disk space without an appropriate reseller agreement; use of servers for backup of files unrelated to the website of the account; or resale or remote access to CGI scripts installed on our servers.

6. Background Running Programs

We may allow programs to run continually in the background. These are considered on a case-by-case basis and an extra charge will be incurred based on system resources used and operational maintenance needed.

7. Chat Rooms

We do not allow clients to install their own chat rooms. These tend to be a large drain on system resources and we cannot allow it as an account option.

8. IRC

The operation of IRC or IRC bots on our servers will result in an immediate suspension of service.

9. Data Backup & Recovery

While we back up files on a daily basis, we are in no way responsible for the archiving of a site. It is the sole responsibility of the site creator to copy, back up or archive all files that constitute a website.

10. Cancellations

Although no notice is required, and there is no cancellation fee, all fees paid for service up to the notice of cancellation are non-refundable. If cancellation is made within the first 30 days of service all hosting fees will be refunded. This does not include domain registration fees, setup fees or any charges associated with the purchase of supplemental services.

11. Billing

All clients are billed one month in advance. All payments are due 30 days from invoice. Past due payments are subject to late fees. An account that is past due for two or more billing cycles is subject to termination. Accounts paid by credit cards that are rejected by our online card processor are grounds for termination. Because of the risk of credit card fraud, any account which offers two bad credit cards within any 6 month period will be subject to immediate termination. If you need to update your credit card information, please access your control panel and click on the “Update Billing” icon.

12. Money-Back Guarantee

If for any reason during the first 30 days, you are not completely satisfied with our service, we will refund your money. If you have any concerns regarding your account and are still looking for a resolution to a problem or question, we encourage you to contact us. However, if you are still in anyway unsatisfied with one of our products, please contact us within 30 days after the initial purchase for a refund. The money-back guarantee applies to the monthly fee associated with your account. It does not apply to the setup fee, domain registration fees or any charges associated with the purchase of supplemental services. Please note that the money-back guarantee is only applicable to the initial sign-up fee and not for subsequent renewal fees.

13. Suspension

Activity which results in a suspension or deactivation of an account will result in a forfeiture of fees paid. Complaints made regarding abuses of an account will be grounds for suspension.

14. Refusal of Service

We reserve the right to refuse, cancel, or suspend service at our sole discretion. All sub-networks, distributive hosting sites, and dedicated servers of Global Hosting Services Inc. must adhere to the above policies. Failure to follow any term or condition will be grounds for immediate account deactivation.
